136 - Nordstream and Lack of Jurisdiction by Sweden and Denmark





Sweden and Denmark closed their pre-investigation cases.

They stated that they Lack Jurisdiction over the explosions in its exclusive economic zone (EEZ).
It could be for several reasons:

International Law: 

Sweden and Denmark may have determined that under international law, jurisdiction over the incidents falls under the principle of flag state jurisdiction. This principle dictates that the state whose flag the vessel carrying out the activities was flying has primary jurisdiction. Since the Nordstream pipelines are a joint project involving multiple countries, and the explosions were likely caused by a state actor, jurisdiction may fall to the state(s) whose flags the vessels involved in the explosions were flying.

Multinational Ownership: 

The Nordstream pipelines are jointly owned by Russia, Germany, the Netherlands, and France, with Russia owning 51% and the other countries collectively owning 49%. Given this multinational ownership, determining jurisdiction may require agreement among all involved parties or may default to the flag state principle mentioned earlier.

Political Considerations: 

Sweden and Denmark may also consider the geopolitical implications of asserting jurisdiction over incidents involving state actors from other countries. In this scenario, where the likely perpetrator is believed to be Britain, Sweden may not want to escalate tensions or become embroiled in a diplomatic dispute by asserting jurisdiction without clear legal grounds.

The principle of flag state jurisdiction is primarily associated with ships and maritime vessels, but it can also extend to other assets such as offshore installations, pipelines, seabed cables, and similar structures.

For example, in the case of offshore installations such as oil rigs or wind farms, the flag state of the vessel or platform used in the construction, operation, or maintenance of these installations would typically have jurisdiction over activities and incidents related to that installation, even if it is located within the exclusive economic zone (EEZ) of another country.

122 - Sweden announces it lacks jurisdiction in the Nordstream case

The jurisdiction issue explored

Swedish officials claim that they “lacked jurisdiction” to reveal what happened and have now handed their evidence to German investigators.

“We have a picture of what has happened, and what that picture consists of we cannot go into more detail, but it leads to the conclusion that we do not have jurisdiction,” Swedish Public Prosecutor Mats Ljungqvist told Reuters. “It is not Sweden’s task to continue this investigation.”

Sweden may lack jurisdiction over the explosions in its exclusive economic zone (EEZ) for several reasons:

1. International Law: Sweden may have determined that under international law, jurisdiction over the incidents falls under the principle of flag state jurisdiction

This principle dictates that the state whose flag the vessel carrying out the activities was flying has primary jurisdiction. Since the Nordstream pipelines are a joint project involving multiple countries, and the explosions were likely caused by a state actor, jurisdiction may fall to the state(s) whose flags the vessels involved in the explosions were flying.

  • In mid September before Nordstream was attacked there was a series of drone spotting around key Norweigean oil/gas infrastructures.
  • A few days before the attack on Nordstream pipelines there was an attack on the SouthStream.
AFTER 26-09-2022
  • In October after Nordstream was attacked there were another spotting of drones in Norway.
  • After Nordstream was attacked there was another unsuccessful attempt on SouthStream 
SWE INVESTIGATOR MATS LJUNQUIST MENTIONS 
THAT RED HERRINGS WERE PLANTED
  • In April 2023 Mats Ljunquist stated that perpetrators planted several Red herrings.

HYPOTHESIS:

=> Could these be before/after Red herrings on the Western side? 

Post about drones in Norway is here. Unidentified drones appeared before and after the event and had a significant value in Public Relations management. They could be possible planted to manage public perception of the Nordstream affair.

Post about two rather amateur attempts to attack land base installation of TurkStream could be found here. Ukrainian linked Russian collaborators were discovered. The suspected attempt to sabotage discovered clear evidence about intentions. Could this be linked to possible management of public opinion about who was behind Nordstream attacks?     


These two instances (if true) may not be the final count of fishy planted actions and stories by perpetrators to confuse investigation.

21 Oct 2022 - Several submarine cables in the south of France were cut

Several submarine cables in the south of France were cut overnight, affecting the internet around the world. It is likely the work of Russian submarine saboteurs, but investigators have so far found no evidence of the country’s involvement in the damage.

At least three fiber optic cables were cut in southern France on Wednesday evening, October 19, slowing internet access for users in Europe, Asia, and the US. Cloud companies promptly repaired the highway.

According to a report by cloud security company Zscaler, the unexpected cable damage resulted in packet loss and increased latency for websites and applications traveling along the affected paths. The company identified three faulty circuits: Marseille-Lyon, Marseille-Milan and Marseille-Barcelona. Zscaler made adjustments to internet traffic routing where possible to mitigate the issue. Search operations to identify damaged sections of the submarine cable are still ongoing.

Damage to subsea communication cables near the Faroe and Shetlands Islands left much of the islands without internet access. Subsea fiber-optics cables in the south of France were also cut in what authorities call acts of sabotage.

Mats Ljungquist states clearly that false evidence and stories were planted. This means the SWE investigator KNOWS who has done it and KNOWS which stories and evidence is odd and does not belong to the conclusive evidence pointing to the perpetrator.

The people who did this have probably been aware that they would leave clues behind and probably took care so that the evidence would not point in one direction, but in several directions … That makes it difficult to clearly point to one actor.

[M: This hints that the investigation is checking relationship between several groups and who knew what at certain time. Then there is of course a deductive logic which points to just one perpetrator - the UK.] 

"I don't want to comment on any specific report but I can conclude that many of the hot theories can be easily ruled out based on what we know from the investigation," he said.

22 Sept 2022 - FSB thwarts terror attack on gas pipeline from Turkey to Europe

The would-be terrorist was apprehended when taking two powerful self-made explosive devices from a cache

"The Federal Security Service has thwarted an attempt by the Ukrainian special services to conduct a terror attack on an oil and gas facility being used for energy supplies from Turkey to Europe," the FSB reported. The perpetrator, a Russian national born in 1978, recruited by the Ukrainian security services in Ukraine, and his four Russian accomplices have been detained, the FSB added.

The would-be terrorist was apprehended when taking two powerful self-made explosive devices from a cache. Mobile devices with text and audio records of his conversations with a curator and instructions on how to assemble the explosive device and money transfer details as well as the coordinates of the intended explosion site were found on the Ukrainian security service agent.

13 Oct 2022 - Russia detains saboteurs trying to blow up TurkStream

A Russian-Turkish project has been subjected to sabotage as attacks continue on Russia's energy infrastructure.

The Russian authorities have detained several saboteurs as they were trying to sabotage and blow up a part of the TurkStream pipeline that is on Russian territory, Kremlin spokesperson Dmitry Peskov said on Thursday˙´.

[MRT: Looks like a different saboteur. It is easy to repair pipes on the land compared to the broken undersea line. If the Nordtsream was done by Ukraine why not to use the same technology, mission? Why not to blw them at the same time? Looks like these two are unrelated.]

"Saboteurs were taken, several people were detained - they wanted to blow up [TurkSteam] on our territory, on land," Peskov told reporters. The pipeline starts in the Russian Krasnodar region.

"Moscow does not have the habit of "shooting itself in the leg", Peskov added, dismissing remarks made by Ukrainian President Volodymyr Zelensky, who said Russia was planning on sabotaging its infrastructure of gas pipelines.

"We do not tend to shoot ourselves in the leg," Peskov underlined.

According to Kremlin spokesman Dmitry Peskov, the TurkStream gas pipeline would not replace the Nord Streams because they have different capacities.

Investigators from Russia's Federal Security Service (FSB) later started a criminal investigation into the blasts as an act of international terrorism.

"There is no doubt that this is an act of international terrorism, the purpose of which is to undermine the energy security of the entire continent," Putin told the Russian Energy Week in Moscow on Wednesday.

Putin previously accused the West of being behind the damage to the Nord Stream pipelines. He said it had already "practically begun to destroy shared European energy infrastructure," stressing that "it is obvious to all who is profiting from this."

Gazprom wants to rearrange its natural gas pipeline transit routes to Europe through Turkey after the two Nord Stream pipelines were damaged...

Gazprom CEO Alexei Miller said last week during the Russian Energy Week conference in Moscow that the new transit through Turkey could fully replace the lost Nord Stream capacity, potentially alluding that Gazprom intends to increase Turk Stream capacity even further than the planned 63 Bcm/yr.

Putin said Europe must make it clear that it needs the gas from an expanded Turk Stream before Moscow starts investments

21 sept 2022 - Two new drones observed in the North Sea

Unidentified drones continue to appear in the North Sea. Two new drones have now been observed.

On Saturday, what is described as a "severe" drone was observed near the Kristin field. On Tuesday, a new drone appeared which should have been less than 50 meters from the Heidrun platform, Stavanger Aftenblad reports.

Unidentified drones continue to appear in the North Sea. On Saturday, a "severe" drone was observed near the Kristin field and on Tuesday, a new drone appeared which is said to have been less than 50 meters from the Heidrun platform.

Equinor has reported

- We have made observations of unidentified drones at some of our installations, confirms Eskil Eriksen, press spokesperson at Equinor.

- We take the incidents seriously and report the observations to the Norwegian authorities, the Petroleum Safety Authority and the police, Eriksen asserted.

He says that Equinor is in dialogue with the governing authorities regarding follow-up of the drone activity.

several sightings of unidentified drones/aircraft in the vicinity of offshore installations

The Petroleum Safety Authority Norway encourages increased vigilance from all operators and shipowners on the Norwegian continental shelf and reminds them to notify and report observations to us, in accordance with Section 58 of the Framework Regulations Notification and reporting in connection with security zones.

Unidentified drones/aircraft may involve increased risk in areas such as - helicopter traffic and SAR helicopters

- ignition source control - non Ex approved equipment in the vicinity of explosive areas hazardous areas
- falling objects - collision with equipment 
- deliberate attacks

We assume that some of the players in the industry are already familiar with this. Nevertheless, we consider we consider it relevant to provide information about these incidents. We encourage further vigilance, review of emergency preparedness measures and incident management and information sharing.

Furthermore, communication in general in the petroleum the petroleum industry and with cooperating authorities. We ask that relevant personnel in the individual operating company and the individual shipowner, and the safety service are made aware of the contents of this letter.

Prime Minister Jonas Gahr Støre and Equinor CEO Anders Opedal visited the Sleipner A platform in the North Sea on Saturday.

Following the Nord Stream 1 and 2 explosions as well as "unusually high" drone activity at Norwegian oil and gas installations, Prime Minister Jonas Gahr visited the Støre Sleipner A platform on Saturday.

"Traveling offshore is always special. Today was perhaps a little extra special", opened Equinor CEO Anders Opedal.

No threat information

Støre also repeated what he also said at another press conference on Friday:

"We have no information that there is a threat to us, but as the situation is now, it is wise and sensible to step up preparedness - and we are doing that", he said, and pointed to close cooperation with the companies operating on the Norwegian continental shelf...

“This is part of challenges from so-called ‘hybrid threats’ that can challenge preparedness and security,” Støre told news bureau NTB Friday afternoon. “We are following this closely.

Støre also noted that the police are actively investigating drone sightings, the latest of which set off alarms Thursday night at state oil company Equinor’s huge gas processing plant at Kårstø between Haugesund and Stavanger.

There are certain companies that have certain special missions that mean they could, in theory, carry this out … We don’t rule out anything, but that it is a state actor who is directly or at least indirectly behind this is of course our absolute main scenario, given all the circumstances.

The people who did this have probably been aware that they would leave clues behind and probably took care so that the evidence would not point in one direction, but in several directions … That makes it difficult to clearly point to one actor.

[M: This hints that the investigation is checking relationship between several groups and who knew what at certain time. Then there is of course a deductive logic which points to just one perpetrator - the UK.]
