14 July 2023 - By e-mail of 1 March 2022, the Claimant informed the Tribunal as follows: 

1. The designation of Nord Stream 2 AG as a US Specially Designated National (SDN) on 23 February 2022 and recent geopolitical developments have led to an inability on the part of the Claimant to pursue the arbitration at this time. In particular, the Claimant’s bank accounts have been blocked, meaning NSP2AG is unable to make any payments or access finance.

2. The Claimant consequently requested a suspension of the arbitration.

By letter dated 8 June 2022, the Claimant informed the Tribunal that it had been granted a provisional composition moratorium until 10 September 2022 by the Cantonal Court in Zug, by which date the Cantonal Court would decide on a definitive composition moratorium, an extension of the provisional composition moratorium, or a declaration of bankruptcy. The Claimant noted that, given these circumstances, until “that point in time [it] will not be in a position to give any further substantial indication concerning its circumstances, its ability to continue the proceedings, nor on the further conduct of the proceedings, or on timing.

Accordingly, it requested a continuation of the suspension of the proceedings and a postponement of the 20 June 2022 procedural meeting until a date after 10 September 2022. .. ”

10 Sept 2022 - Nord Stream 2 gas link operator wins further stay of bankruptcy: court

A Swiss court has granted the operator of the Nord Stream 2 gas pipeline from Russia to Germany a stay of bankruptcy until early January, as calls from within Germany for the link to be opened continue.

On May 11, Switzerland-based Nord Stream 2 AG was awarded a provisional stay of bankruptcy until Sept. 10, according to a notice in the Swiss Official Gazette of Commerce.

28 Dec 2022 - Nord Stream 2 pipeline firm gets 6-month stay of bankruptcy

A Swiss court has granted a six-month “stay of bankruptcy” to the operating company for the never-opened Nord Stream 2 pipeline, which was built to bring Russian gas to Germany but put on ice shortly before Russia invaded Ukraine in February.

The company’s stay was extended from Jan. 10 through July 10 by a regional court in the Swiss canton (state) of Zug, according to a notice published Wednesday in the Swiss Official Gazette of Commerce.

Nord Stream 2 AG, a subsidiary of Russia’s Gazprom, is based in Zug. Nord Stream 2’s court-appointed administrator, Transliq AG, sought the extension.

German Chancellor Olaf Scholz’s government halted the certification process for the pipeline on Feb. 22, after Russia recognized the independence of two separatist regions in eastern Ukraine. Russian President Vladimir Putin ordered sent troops into Ukraine two days later, and U.S. President Joe Biden President then directed his administration to impose sanctions on the Nord Stream 2 operating company.

Reason unclear but a source suggests “paranoia over govt messaging before an election”

“The insider added that control in No 10 was worse under Rishi Sunak than under previous prime ministers” “As a result [of raising concerns] Admiral Radakin and General Sandersare said to have been prevented on several occasions from speaking to the media.

Some spy agencies have been blocked from issuing statements about specific events, another source said. One dept dealing with security issues was told it could issue ‘reactive’ statements only in case it distracted from the No 10 agenda”

5 March 2024 - Signs were present Nord Stream sabotage acts committed by Anglo-Saxons — intelligence

Some indirect signs pointed to Anglo-Saxon countries being behind terrorist acts at Nord Stream and Nord Stream 2 gas pipelines and the "jigsaw puzzle was put together" then, Russian Foreign Intelligence Service (SVR) Director Sergey Naryshkin said.

Nordstream and Lack of Jurisdiction by Sweden and Denmark





Sweden and Denmark closed their pre-investigation cases.

They stated that they Lack Jurisdiction over the explosions in its exclusive economic zone (EEZ).
It could be for several reasons:

International Law: 

Sweden and Denmark may have determined that under international law, jurisdiction over the incidents falls under the principle of flag state jurisdiction. This principle dictates that the state whose flag the vessel carrying out the activities was flying has primary jurisdiction. Since the Nordstream pipelines are a joint project involving multiple countries, and the explosions were likely caused by a state actor, jurisdiction may fall to the state(s) whose flags the vessels involved in the explosions were flying.

Multinational Ownership: 

The Nordstream pipelines are jointly owned by Russia, Germany, the Netherlands, and France, with Russia owning 51% and the other countries collectively owning 49%. Given this multinational ownership, determining jurisdiction may require agreement among all involved parties or may default to the flag state principle mentioned earlier.

Political Considerations: 

Sweden and Denmark may also consider the geopolitical implications of asserting jurisdiction over incidents involving state actors from other countries. In this scenario, where the likely perpetrator is believed to be Britain, Sweden may not want to escalate tensions or become embroiled in a diplomatic dispute by asserting jurisdiction without clear legal grounds.

Limited Scope of Jurisdiction: 

Even though the explosions occurred within Sweden's and Denmark´s EEZs, the scope of Sweden's and Denmark´s jurisdiction may be limited to certain types of offenses or activities explicitly outlined in international law or domestic legislation. If the explosions do not fall within these defined parameters, Sweden may lack the legal authority to investigate or prosecute the incidents.

Flag state jurisdiction 

Flag state jurisdiction is a principle of international law that assigns primary legal responsibility and authority over vessels to the state whose flag the vessel is flying. This principle dictates that the flag state has jurisdiction to regulate, investigate, and prosecute incidents that occur on board its flagged vessels, regardless of where the vessel is located in international waters or the exclusive economic zones of other countries.

The principle of flag state jurisdiction is primarily associated with ships and maritime vessels, but it can also extend to other assets such as offshore installations, pipelines, seabed cables, and similar structures.

For example, in the case of offshore installations such as oil rigs or wind farms, the flag state of the vessel or platform used in the construction, operation, or maintenance of these installations would typically have jurisdiction over activities and incidents related to that installation, even if it is located within the exclusive economic zone (EEZ) of another country.

Similarly, pipelines and seabed cables may also fall under the jurisdiction of the flag state of the vessels involved in their construction, maintenance, or operation. However, the application of flag state jurisdiction to these assets can vary depending on specific international agreements, treaties, and domestic laws governing their operation and jurisdictional issues.

In summary, while the principle of flag state jurisdiction is traditionally associated with ships, it can extend to other maritime assets such as offshore installations, pipelines, seabed cables, and similar structures, subject to applicable international agreements and domestic laws.

Summary:

Overall, Sweden's announcement that they lack jurisdiction over the explosions in their EEZ may stem from a combination of legal principles, multinational ownership of the pipelines, political considerations, and the limited scope of their jurisdiction under international law.
